Non-Disclosure Agreement

This agreement Is made between Lowenberg Consulting (the Company) and the Client (named below), to protect the Client’s commercial confidence and interests while providing certain information about the Client’s business and authorizing access to selected Market Research Referees to the Company and its consultants for the sole purpose of enabling the Company to gather and process that body of data and information provided to conduct a ProfitDriver Analysis and to render the Client a ProfitDriver Report identifying areas of and opportunities for improving the performance of the Client’s business.

The Client agrees to provide information which is, to the best of their knowledge, true and accurate, on the understanding that this information will form the calculational and referential basis of the resultant ProfitDriver Report.

The Company and its directors, coaches, consultants, advisors, employees, and agents, agree to exercise all commercial care in protecting the confidentiality of the Client’s data, information and intellectual property (Inputs); to utilize all Inputs solely for the purposes of making certain measurements, judgment, and recommendations about the Client’s business, to the Client; and thereafter to destroy on request, or to store securely, all Inputs to the Analysis.
